Does Your Property have an On-Site Sewage Facility? Please Read Fee Change Info

This letter is to inform you of fee changes made by the Hays County Commissioners Court.
The Hays County Commissioners Court believes all citizens who are in compliance with their On-Site Sewage Facility (OSSF) maintenance contract should no longer be responsible for the Annual On-Site Sewage Facility Registration Fee. For those who are not in compliance a $50 Late Fee will be assessed to the property owner.
Effective April 7th, 2011, owners of an On-Site Sewage Facility (OSSF) that requires maintenance, such as an Aerobic Spray, Drip Irrigation, Sand Filter or Constructed Wetlands, are required to submit a contract with a licensed Maintenance Provider to Hays County Development Services. In addition to the submittal of your contract, an Annual Registration Fee of $20.00 is required to operate an OSSF utilizing surface application or an OSSF that requires a maintenance contract under TCEQ Regulations (30 TAC 285). This fee was paid at the time of contract submittal.
On Tuesday, July 24th, 2018, the Hays County Commissioners Court adopted to remove the $20 Annual OSSF Registration Fee from the Hays County Development Services Fee Schedule. During the same proceedings, the Hays County Commissioners Court adopted a $50 Late Fee if a new maintenance contract for your system is not filed before the date of expiration of the previous contract.
Prior to the maintenance contract expiring, each property owner will receive two notifications. These notifications are friendly reminders and will be mailed to the property address on file. The first notification will be 60 days prior to the expiration date of the current contract. The second notice will be sent 30 days prior to the expiration date of the current contract. Once any notification is received, the property owner should contact (if not already) their licensed Maintenance Provider to sign a renewal contract. All maintenance contracts must be signed by both the property owner and the Maintenance Provider to be a valid contract.
Per Hays County Commissioners Court Resolution Number 33051, there will be an administrative waiver of the $50 Maintenance Contract Late Fee until January 1st, 2019. All contracts will be subject to incur a $50 late fee, beginning January 1st, 2019. The maintenance contracts and late fee are the responsibility of the property owner.
