March 20, 2020 Family Court Notice

Pursuant to the Texas Supreme Court (Order 20-9042) and the Texas Court of Criminal Appeals (Order 20-007) and by recommendation from the 3rd Regional Presiding Judge and the Texas Office of Court Administration, all jury trials are cancelled through May 31st, 2020.

Additionally, all non-jury dockets are cancelled through April 12111, 2020.  Essential hearings will

be conducted. Essential hearings are criminal matters such as magistration, writs of habeas corpus, civil matters such as mental health commitments, juvenile detentions, emergency CPS removals, family violence protective orders, temporary restraining orders, habeas corpus proceedings arising under the Texas Family Code and any other matter that may be deemed an essential matter by the Court.

If there is a plea ready, a non-contested hearing or if all parties agree to a hearing please call the court to get a court date. Video conferencing is currently being evaluated for use in the courtrooms to conduct hearings by this method.

Please do not come to the courthouse without calling the court for any District Court matter. Attorneys and parties are expected to recognize the emergency and public health nature of this situation and to cooperate in presenting to the Courts only those matters that must be resolved immediately and that are fully ready to be resolved. The Courts strongly recommend to all litigants to take this time to work a solution to your cases.

IF ANYBODY IS HAVING SYMPTOMS SIMILAR TO COVID-19, RECENTLY TRAYELLED INTERNATIONALLY  OR OUT OF STATE, OR HAS COME IN CONTACT WITH SOMEONE WHO HAS TRAVELLED OR IS SICK, DO NOT COME TO COURT. CONTACT THE COURT AND THE COURT WILL MAKE THE NECESSARY

SCHEDULING CHANGES TO ACCOMMODATE.

Pending future public health developments, the District Courts will resume normal operations April 13th, 2020 for n  n-jllly dockets and June ist, 2020 for jrny trials.

District courts are the trial courts of general jurisdiction of Texas. Hays County is served by four district judges, several of whom divide their time among other counties as provided for by state law. The geographical area served by each court is established by the Legislature, but each county must be served by at least one district court. District judges are elected and are employees of the State of Texas, although their staffs may be employees of specific counties in which they hear cases.

District courts have original jurisdiction in all felony criminal, civil and family law cases.

The Legislature has authorized the appointment of associate judges to assist the district courts in a variety of cases, including civil, family, juvenile and criminal matters. Generally, associate judges are appointed by the court or courts they serve and can be either county or state employees. Associate judges hear cases referred to them by district judges.

All District Court trials in Hays County are conducted at the Hays County Government Center, 712 South Stagecoach Trail, Third floor, San Marcos, Texas 78666.
