Former teacher found guilty on three counts of sexual assault of a child

SAN MARCOS, Texas – Hays County District Attorney Kelly Higgins announced today that on November 2, 2023, David Ross Guerrero, was found guilty by a Hays County Jury of three counts of sexual assault of a child. Guerrero was an English teacher and assistant coach for the girls’ soccer team at the San Marcos High School from 2008 until the time he resigned in 2013.

In 2018, a female victim reported the sexual assaults that happened in 2009 and the San Marcos Police Department investigated. The victim was a student at SMHS and the defendant engaged in a sexual relationship with the victim.

Information gathered during the investigation led SMPD to believe there were other similar victims at SMHS between 2008 and 2013. After the defendant was found guilty by a Jury, three additional victims, who were former students of Guerrero, testified during the punishment phase of the trial outlining defendant’s inappropriate behavior and sexual relationships with them while he was a teacher at SMHS. Guerrero was sentenced to 2 ½ years’ imprisonment on the first count, to be followed by ten years’ probation for the remaining counts.

This case was investigated by SMPD Detective Casey Tennant and Detective Robert Elrod. The prosecutors for the case were Shelby Griffin and Miranda Ebersole.
